Termination Due to Being a Whistle Blower 1024



  • What can you do if you were terminated because the employer of non-profit thought you were going to be a whistle blower due to non-compliance and destruction of documents.
    Does a person have and legal recourse. Most attorneys in GA do not want to deal with non-profit law suits. I filed complaint with the Secretary of State months ago but nothing has been done.

    Can you give more details? What do you mean ‘thought’ you were going to be a whistle blower. You can not prove anything in court if the employer only thought something, we must have some facts.
    For example, they will never admit that they fired you because ‘you were going to be a whistle blower due to non-compliance and destruction of documents’.
    You are in the land of litigation, where people with technical background feel like a fish out of the water, and there is no manual explaining how to make use of the air that is dissolved in water, just like fish do. As an expert witness, it took years to learn these undocumented features.
    Another problem: Sarbanes Oxley is not for non-profit organizations. The employer may follow some or all the procedures of SOX.



  • The day before two board members came in(and it was not known to the rest of the board), the Exec. Dir. broke into my file cabinet to get the document(log book) and took other things out of the cabinet. I had copied part of the book so there is proof it existed.



  • it doesn’t sound like there is enough evidence to prove that termination was due to what they thought you might do to them.
    the executive director can probably make a good case for obtaining a log book and other items. they will probably say they needed them for a meeting. they probably already have their stories made up and will be ready with a smear campaign against you.
    are there any other reliable witnesses to the destruction of documents?
    unfortunately, sox won’t help you.
    from an employment perspective, please move on to other opportunities.
    you may be able to look into government agencies that keep tabs on non-profits (IRS) and investigative reporters with an interest in researching this a bit more. it may expose the non-profit and their practices but it won’t help you with getting a job.
    you have to decide who much energy to give to this effort.
